Statewide: no moratorium bill in our records; SB 484 concern tax breaks, siting or power costs. Florida adds a trap: Chapter 2025-190 bars moratoria and more restrictive land rules for one year after a hurricane in affected counties, and Section 28 voids more restrictive rules in Debby, Helene and Milton counties before October 1, 2027. SB 484 (2026) separately confirms local authority to reject data centers.

Moratoria reaching their stated end in the next 90 days

106 active moratoria hit their end date by January 31, 2027. An end date is the earliest a pause can lapse, not proof that it will: Lexington, Cleveland, Snohomish County and DeKalb County are among those whose official records show an extension or a pending one. The first 30 follow; the CSV has them all.

Are data center moratoriums legal?

Generally yes, if state law gives the local government that power and it follows the procedure. There is no federal ban on them, and the US Supreme Court has held that a temporary moratorium is not automatically a taking. The real limits are in state law, and they differ sharply. Not legal advice.
Source What it says Why it matters for data centers
Tahoe-Sierra v. Tahoe Regional Planning Agency, 535 U.S. 302 (2002) Two moratoria totaling 32 months “are not per se takings of property requiring compensation”; such claims turn on the facts. A developer can still argue a taking on its facts, but a 12-month pause is not automatically compensable.
N.C. Gen. Stat. 160D-107 (Internet Archive copy) Local governments may adopt temporary moratoria on development approvals, but must state the problem, a termination date and a work schedule. Valid building permits and complete special use applications are exempt. Each North Carolina ordinance must carry those statements, and a project already permitted keeps going.
Minn. Stat. 462.355, subd. 4; 394.34 Cities may adopt an interim ordinance to “regulate, restrict, or prohibit any use” for up to one year. County interim zoning runs one year, with one year of renewal. Sets the one-year term seen in Minnesota townships and counties.
RCW 36.70A.390; 35A.63.220 Moratoria may last six months, or one year with a work plan, renewable in six-month steps after a hearing and findings. Snohomish County’s six-month renewal ordinance follows this rule.
N.J.S.A. 40:55D-90 (FindLaw copy dated Jan. 1, 2024; the state site timed out) “No moratoria on applications for development or interim zoning ordinances shall be permitted” except on a health professional’s written opinion of “a clear imminent danger”, and never beyond six months. In our ledger 42 of 51 active New Jersey moratoria and bans are bans, against 49 of 598 elsewhere.
Laws of Florida ch. 2025-190, ss. 18 and 28 For one year after a hurricane, affected local governments may not adopt a moratorium on construction or more restrictive land rules. In Debby, Helene and Milton counties, more restrictive rules before October 1, 2027 are “null and void ab initio”. Any person may sue. Florida’s local data center pauses may face this challenge. We did not test which ones fall in covered counties.
Texas AG request RQ-0634-KP (filed Feb. 25, 2026) Delta County’s attorney asks whether Texas counties have “any express, direct, and specifically granted” authority to impose a moratorium on data centers and other facilities. We did not find a published answer as of November 2, 2026. Hill County’s pause was rescinded in June 2026 after a federal suit, per press reports.
New York Executive Order 62 (Internet Archive copy) The state holds discretionary environmental permits for data centers of 50 MW or more; the order “does not apply to permits, approvals, licenses, or similar forms of permission from local governments”. A statewide pause by order can be narrow; local permits are separate.

Separately, news coverage describes suits over local pauses in Eagan, Minnesota, Chatham County, North Carolina and Hill County, Texas. We read that coverage, not the court filings, so these are not part of the legal answer above.

Statewide bills and orders

We read 34 statewide moratorium measures in 23 states. Governors’ orders are in force in three states, one bill passed but is unsigned, one was vetoed, and the rest are in committee, proposed for 2027 or dead. Oregon’s order covers state land only, and Texas’s two directives run until an audit ends, so neither is a general construction ban.

Related state action on tax breaks and power tariffs

Some states acted on incentives and power costs rather than on building. These rows directly affect whether a data center gets built; they are not every energy bill.

The federal AI Data Center Moratorium Act

It exists, as two identical bills, and neither has moved. S. 4214, from Sen. Bernie Sanders, was introduced March 25, 2026 and referred to Commerce, Science, and Transportation, with no cosponsors. H.R. 9442, from Rep. Alexandria Ocasio-Cortez, was introduced June 24, 2026 and referred to Energy and Commerce and Foreign Affairs; it has 20 cosponsors, the latest added October 15, 2026. The Congressional Research Service summary says the bill bars building or upgrading AI data centers until laws are enacted that require federal prerelease review of AI products and protect workers. The bill text covers facilities used to develop or run AI models at scale, or those above 20 megawatts that have high-density racks or liquid cooling. Unless enacted, both lapse when the 119th Congress ends. We read these records in the Government Publishing Office’s bill status files, because congress.gov blocked our requests.

How long a data center moratorium lasts

The median term is 12 months across the 532 moratoria where a term in our leads matched the term in the source document, and 47% run about a year. 34 ran under three months, mostly California 45-day urgency ordinances, which can be extended. Longer pauses are rarer: 41 run 13 to 24 months and 11 run longer than that. 82 moratoria have passed their stated end, and 18 local actions were lifted or rescinded. We did not check every expired term for a renewal, so “term ended” means the date passed, not that the pause is gone.

Do moratoria follow the data centers?

Only partly. The five states with the most mapped sites (Virginia, Texas, California, Oregon, Ohio) hold 53% of the 1,205 sites in the PNNL atlas but only 15% of active local moratoria and bans. Across all states, site counts and active measures move together (Spearman rank correlation 0.6), but Michigan (47 active measures, 10 mapped sites), North Carolina (45, 17) and Kentucky (27, 5) sit far above their site counts, while Virginia, the largest market with 239 sites, has 6. The atlas counts mapped sites as of February 2026, so it misses projects still in planning. Census data puts data center construction spending at an $85.0 billion annual rate in August 2026, up 73% in a year.

How good is the evidence?

We opened every source link rather than trusting a tracker’s label. Of 1,052 rows, 243 rest on a primary record and 809 are press only, so 77% of this list has not been matched to a government document. Local counts: 213 primary, 791 press only. Statewide: 30 primary, 18 press only. 312 further leads are excluded because the source was blocked, gone or did not support the row; the Internet Archive rate-limited our attempts to read blocked pages, so a later rerun should recover some.

The gap matters for dates. For 22 rows with both a press-derived day and an official Legistar vote date, 11 agreed within three days; in several of the others the earlier date was an introduction or a tabled vote, not final passage. Use official dates when a deadline depends on them.

Other trackers report larger counts. AI GridWatch lists 887 actions and says 68 cite the enacting body’s own record; SAVRN lists 1,304 local measures; Electric Choice lists 575 active restrictions. Those are useful and we credit them below. Their scopes differ, and SAVRN’s and AI GridWatch’s totals include proposed and failed measures. Our count is lower because we merged 111 duplicates, dropped 246 weak zoning rows and left out 312 rows we could not confirm.

What this means for MSPs

Colocation capacity. These measures stop new approvals, not running facilities. North Carolina’s statute, for one, exempts projects with valid building permits. The exposure is at renewal, when a provider’s expansion or replacement capacity may depend on a permit now on hold. Ask colocation vendors in Texas, New York and the 63-moratorium state of Ohio which expansions are already permitted, and get expansion rights in the contract.

Client site planning. Size thresholds vary widely. New York’s order starts at 50 MW and a pending Baltimore bill (26-0217) at 5 MW, but Skagit County, Washington’s moratorium covers facilities over 2,000 square feet or two megawatts, and Madison, Wisconsin’s reaches its zoning certificates for data centers and telecommunications centers. 76 rows in our ledger note a size or power threshold; the rest may have none. Before a client builds a server room or edge site in a covered town, have the zoning office confirm in writing that the definition does not reach it.

Local power. Tariff laws such as New Jersey S731 and Delaware’s 20 MW rate class aim costs at large loads, not a client’s small room, but rate pressure shows up regionally; our data center electricity prices report covers it by state. ERCOT is weighing about 474 GW of requests, most from data centers, per the Texas governor’s office, so plan generator and UPS runtime on the assumption that grid upgrades will lag. Where the fight is over water, our data center water usage report has site-level numbers.

Frequently asked questions

Which states have a data center moratorium?

No state has signed a moratorium statute. Three states have governors’ orders that pause some state approvals: New York (Executive Order 62), Texas (ERCOT audit and TCEQ permit directives) and Oregon (state land only). 45 states have at least one active county, city or township moratorium in our ledger, led by Ohio (63), Michigan (47), North Carolina (44).

How many states have passed a data center moratorium?

Two legislatures have voted one through: Maine (LD 307, vetoed April 24, 2026) and New York (A11560, passed June 4, 2026, no signature shown). We counted 34 statewide moratorium proposals, orders and bills in 23 states; most are in committee or dead.

Are data center moratoriums legal?

Generally yes where state law gives local governments the power and they follow it, but it depends on the state. The US Supreme Court held in Tahoe-Sierra (2002) that moratoria are not automatically takings. North Carolina, Minnesota and Washington authorize them with limits. New Jersey bars them except for documented imminent health danger, and Florida bars them for a time in hurricane-affected counties. This is not legal advice.

Is there a data center moratorium in Texas?

Yes at the state agency level, and in some towns and counties. Governor Abbott told ERCOT and the PUC on August 3, 2026 to finish an audit before any data center project moves forward, and on September 21 told TCEQ to halt permits sought by data centers. Our ledger has 6 active local moratoria in Texas, and county authority to adopt them is disputed.

What is the AI Data Center Moratorium Act?

Two identical federal bills: S. 4214 (Sen. Sanders, introduced March 25, 2026) and H.R. 9442 (Rep. Ocasio-Cortez, introduced June 24, 2026, 20 cosponsors). They would bar building or upgrading AI data centers until Congress enacts AI safeguards. Both sit in committee with no vote.

How long do data center moratoriums last?

The median stated term is 12 months across 532 moratoria whose source states a term we could match. 47% run exactly about a year. 106 active moratoria reach their stated end within 90 days of November 2, 2026, though many get extended.

Methodology

Where the list comes from. Three open tracker files were used to find candidates: AI GridWatch (data/moratoriums.json, 887 rows, CC BY 4.0), DataCenterTracker.org (data/fights.json, CC BY 4.0) and the SAVRN moratorium tracker’s public citation page (CC BY 4.0). We added official records from search queries limited to government and agenda sites, public Legistar Web API records for 103 local governments, and official links printed inside news articles. Retrieved November 2, 2026.

What “verified” means. A script downloaded every source link and kept a row only if the document mentions data centers and names the jurisdiction within 1,500 characters of that mention. “Primary” means the document is on a government, legislature or official agenda host and passes that test. “Press only” means only a news or other non-government page passed it. Statewide rows were read by hand, and each must contain a stored quote or the build fails. Where a site blocked us and the row had no other source, we tried the Internet Archive copy of that URL. The Archive rate-limited us (HTTP 429) during this run, so most of the 309 blocked links were not retrieved and those rows stay out of the counts; 1 row rests on an Archive copy, and the North Carolina statute was read the same way. We did not open social media links.

Limits of the local rows. Local types, dates, terms and statuses come from the lead files and were checked by script, not read one by one. We read a random sample by hand: 17 of 20 active moratorium and ban rows matched their source on jurisdiction, type and adoption, and 9 of 15 zoning rows did. So expect roughly one active row in seven to have a wrong field, and check a row before relying on it. A primary record can be an agenda showing a proposal rather than a final vote; the status column follows the leads except where a Legistar record shows passage. Where the source shows no adoption wording near the measure, the row reads “Reported, vote unconfirmed” and does not count as active (29 rows).

Coverage bias. The targeted search of official sites hit a limit on search queries and reached only Alabama, Arizona, Arkansas, California, Colorado (partly), Illinois, Indiana, Iowa, Kansas, Minnesota, Missouri, Montana, Nebraska, North Carolina, North Dakota, Ohio, Texas, Utah, Vermont and Virginia. Primary shares are therefore higher in those states, so do not read the primary column as a measure of state transparency.

Definitions. Moratorium: a time-limited or study-linked pause. Ban: a prohibition with no end date. Zoning limit: adopted rules that restrict rather than stop data centers. We kept only those whose lead note shows both an adopted action and a regulatory instrument, and dropped 246 other zoning or ordinance rows, many of them project fights or rezoning approvals, so zoning limits are heavily undercounted. Active: adopted, with no lift or passed end date in our sources. Term ended: the stated end date has passed. Rejected or withdrawn project: a local vote or developer exit on a specific project. Bills that only require reports are excluded. Federal bills are not in the state counts.

Limitations. This is a floor. Small towns without news coverage are missing. Same-named places in one state may be merged. 312 leads are excluded and listed in the CSV as “not confirmed”. Sites are from the PNNL IM3 atlas (February 2026) as used in our earlier report.

Credit and changes. Lead data from AI GridWatch, DataCenterTracker.org (Cam Acosta and George Ingebretsen) and SAVRN, each CC BY 4.0. We merged, reclassified and regraded it, and the notes in the CSV come from those files or from official records. Other trackers’ totals are quoted as counts only.

Not legal advice. This page summarizes public records. Confirm any local rule with the jurisdiction’s clerk or counsel.
